Harvey is not known to have a lost a case, however Mike's life is on the line as Harvey let's him fight for it as he defends himself in court.

Does the jury buy his closing statement
"Ladies and gentlemen of the jury, i think most of us (pauses, then folds his speech). you guys heard evidence earlier in the trial that i have a photographic memory and i do. But the way it works, i don't just take a snapshot of something, you see i read it and then i understand it then u never forget it. I tried to memorize my speech but i cant because its bullshit, because i, i am bullshit. You see the truth is i am guilty of being a fraud, my whole life i wanted to be a lawyer so i can help people like Clifford Daniels, people who have no one to fight for them, no one that believes in them. But instead all i have done as a lawyer is work night and day to put money in the hands of rich people. I was given a gift but I wasted it and i am ashamed of myself, and and and as a final insult I paraded this mourning woman (Clifford Daniels mom) in front of you just as a way to get you to admire me(teary eyes). I am so sorry Gloria and all i can say is whether this people find me guilty or not, I'm gonna spend the rest of my life fighting for the Clifford Daniels of this world. I will not waste that gift again (long pause and faces the jury). You believe it or not I am a lawyer, I always be. Thank you".

But we all know Mike can't go to jail right? Unless they want to give us a shocker.
Harvey is scared unsure of the outcome and doesn't want to depend on the hopes that the jury will find Mike not guilty and tries to cause a mistrial. He blackmails David Green to meet up with a member of the jury unless he tells Anita Gibbs that he is a fraud. But David Green calls his bluff and doesn't show up. Donna tells this to Harvey but its too late, there is no mistrial, Mike's fate rests on the decision of the jury.

Meanwhile, Louis is too scared they will loose and makes a deal to turn on Harvey but Anita Gibbs says hear say is not good enough so he confronts Harvey and makes him admit he hired Mike as a fraud while he records it. Harvey goes to meet Donna that he wants to turn himself in because he feels its all his fault but she convinces him to have faith in Mike.
The next day Mike goes to meet Anita Gibbs for a two year sentence deal, when Harvey notices Mike is no where to be found he rushes to Gibbs' office but Mike is already in.
Harvey should have known Louis was going to record him talk as this is not the first time he has done such and he is not always known to stand firm with the others.
Things are looking really good for Anita Gibbs as more than one person is willing to take a deal, if Harvey doesn't do it, Mike wants to and Louis can't help it. Neither Mike nor Harvey will let the other take the fall.
